What can be registered as a design?+
The features of shape, configuration, pattern or ornament applied to an article — in short, how a product looks, judged by the eye. It protects appearance, not how the product works, which is the domain of patents.
Does my design have to be new?+
Yes. It must be new or original and not already published or shown anywhere. That’s why we advise filing before you launch or display it publicly — prior disclosure can defeat the registration.
How long does protection last?+
A registered design is protected for an initial term that can be extended once, giving up to fifteen years in total. We flag the renewal so the protection isn’t lost by oversight.
Is this the same as a patent?+
No. A design protects the appearance of a product; a patent protects a new invention or how something works. If your product is both novel in function and distinctive in looks, they can complement each other — we’ll advise.
